Regulatory Capture

When the body set up to hold an interest in check comes to serve it instead — without anyone breaking a rule.

The pattern is old and it is structural. A regulator is created to constrain an industry. The industry is concentrated, well resourced, and cares intensely about every decision; the public is diffuse, unfunded, and cares about each decision hardly at all. The regulator needs expertise, and the expertise lives in the industry. Staff move between the two. Over time the regulator's sense of what is reasonable becomes the industry's sense of what is reasonable — and the capture is complete while every individual in it is behaving honourably.

That is what makes it a failure mode rather than a scandal. Nobody has to be bought. Asymmetry of attention, asymmetry of resources, and a shared social world are sufficient, which is why capture recurs across every domain that has regulators at all, and why removing a corrupt official changes nothing (The Pattern Governs, Not People · Systemic Failure Modes · Multi-Polar Traps).

Seen whole, it is one instance of a general law: any body with authority drifts toward serving whoever pays it the most sustained attention. Stated that way, it applies to a wiki's editors, a federation's shared services, a guild, and a council, and not only to a national agency. The counters are all structural and all ordinary. Decisions and their reasons recorded where anyone can read them (Requirement Of Transparency · Decision Records). Roles that end and rotate, so no one becomes the permanent interface to a single interest (Term Limits And Rotation).
